Welcome to Elemental. These Terms and Conditions (“Terms”) govern the use of our website and the purchase of products from our online store. By accessing our site or placing an order, you agree to be bound by these Terms.

2. Our “Made-to-Order” Model

Elemental operates under a slow fashion philosophy. We design in Portugal and handcraft in Colombia. To minimize waste and respect the planet, we do not hold large inventories.

 

  • Production Time: Unless stated otherwise (e.g., items “In Stock”), all garments are made to order. Please allow 8 business days for production before shipping.

  • By placing an order, you acknowledge and accept that your garment is being crafted specifically for you, which influences our delivery times and return policies.

3. Products and Sizing

We strive to display the colors and textures of our products as accurately as possible. However, as our pieces are handmade using natural fabrics, slight variations may occur, making each piece unique.

    Sizing: Many of our items (like Thai pants and Silk jumpsuits) are adjustable or “one size”. Specific sizes (S, M, L) apply to items like the Embroidered Linen Jumpsuits. Please review our Sizing Guide before purchasing.

4. Pricing and Payment

  • Currency: Prices are displayed in [EUR / COP / USD].

  • Payment Methods: We accept PayPal and Bank Transfers.

  • Import Duties: If you are ordering from outside the country of shipment (e.g., a customer in Europe receiving a package directly from Colombia), you may be subject to import duties and taxes, which are the buyer’s responsibility.

5. Shipping and Delivery

Delivery times include the production period mentioned in Section 2.

Shipping within Colombia:

  • Bogotá: Delivered approx. 4 days after production.

  • Rest of the Country: Delivered approx. 10 days after production.

  • Cost: 10,000 COP (Bogotá) | 15,000 COP (Rest of Country).

Shipping to Portugal / Europe:

  • In Stock Items: Immediate shipping.

  • Not in Stock (Made to order): Approx. 30 business days.

  • Cost: Approx. €5–€10 depending on quantity.

     

Free Shipping: We offer free shipping on orders over 400,000 COP or €200.

6. Returns and Exchanges

Due to our sustainable made-to-order model, returning an item involves significant environmental impact and waste. Therefore, our policy is stricter than traditional fast fashion brands.

 

  • Eligibility: We only accept returns or exchanges if the item arrives imperfect or defective.

  • Notification Window: You must report the defect within 24 hours of receiving the item.

  • Condition: The item must be returned in the exact same condition as it was sent.

  • Exchanges: If an exchange is approved, please note that the process restarts as a new order (including production time).

  • Costs: Shipping and return costs are the responsibility of the buyer.

  • Refunds: Processed within 48 hours of us receiving and inspecting the returned item.

(Note for EU Clients: While the EU Consumer Rights Directive typically allows a 14-day withdrawal period, exceptions apply for goods made to the consumer’s specifications. As our goods are made-to-order, we adhere to the policy stated above.)

7. Product Care

We are not responsible for damage caused by improper care. Please follow our instructions: Hand wash in cold water, do not bleach, do not tumble dry, and iron at low temperature avoiding embroidery.

 

8. Intellectual Property

All content on this site (designs, text, graphics, logos, images) is the property of Elemental and is protected by copyright laws.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of [Portugal OR Colombia]. Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts of [City, Country].
